Initial Review of the Rules of the Personal Injury Commission of New South Wales

The Rule Committee of the Personal Injury Commission of New South Wales (Commission) is reviewing the Personal Injury Commission Rules 2020 (Rules), considering how the Rules have operated since the Commission was established on 1 March 2021 (Initial Review).

Submission template: Submissions will be received in the format at Attachment 1.  Submissions cannot exceed 1000 words for each rule discussed.

Who can make submissions? The Commission will invite stakeholder organisations to make submissions - a list is at Attachment 2. The Commission’s preference is for individuals to submit their views through a relevant stakeholder organisation.

Scope of the Initial Review:

The rules that are not operating well in practice – those making submissions should identify the rule/s they consider is not operating well in practice, the reason it is not operating well in practice as well as their proposed amendment.

A more comprehensive review will be conducted in the future.

Review and Change Implementation Timetable
  1. Submissions close on 7 October 2021.
  2. The Rule Committee will vote on proposed changes on or around the end of October 2021.
  3. Drafting instructions will be provided to the Parliamentary Counsel’s Office in or around the end of November 2021.
  4. The amended Rules will commence operation in the first half of 2022 – the Commission will give stakeholders several months’ notice of their commencement.
Recent Rule Change (delayed commencement)
  1. On 2 September 2021, the Rule Committee passed Resolution #1 of 2021. A copy of the Resolution is at Attachment 3. Importantly, the rule changes voted for in Resolution #1 of 2021 will not commence until the commencement date agreed for the changes that are implemented because of the Initial Review.
