Pathway commences for workers compensation users in June 2024, bringing all Commission users onto a single, digital dispute resolution platform
Pathway, the Personal Injury Commission’s digital dispute resolution platform
The Personal Injury Commission’s dispute resolution platform, Pathway, is scheduled to launch for workers compensation staff and decision makers on Tuesday 11 June 2024 and tribunal users on Wednesday 12 June 2024.
This follows the implementation of Pathway for motor accidents users in June 2023.
This major milestone marks the culmination of an extensive program of work since the Commission’s inception to bring all Commission staff, decision makers and parties onto a single digital platform where they can engage online with enhanced cyber security protections.
This will also enable further harmonisation of Commission processes and procedures and provide all users a similar digital experience when interacting with us.
Pathway’s success relies on all users familiarising themselves with the platform and becoming competent in its use. We are committed to working with all users through a comprehensive education and training program, the publication of reference material and ongoing technical support. Training sessions will commence in late May.
Platform outages for all workers compensation and motor accidents users
To enable migration of workers compensation data into Pathway ahead of the launch, the Commission’s platforms for both motor accidents and workers compensation users will be unavailable from 5pm Friday 7 June.
- MyFiles and the Online Portal for workers compensation users will cease operation from 5pm on Friday 7 June.
- myPathway and the Pathway Portal will be unavailable for motor accidents users from 5pm on Friday 7 June.
All workers compensation and motor accidents users can commence using myPathway and the Pathway Portal as follows:
- My Pathway (for decision makers): 10am, Tuesday 11 June
- Pathway Portal (for tribunal users): 9am, Wednesday 12 June
The Commission strongly encourages parties to file anything time sensitive by 5pm, Friday 7 June and to withhold filing until 9am Wednesday 12 June.
For urgent applications or documents during the outage, Rule 23(3)(a) will be used as the mechanism to allow filing via email. Documents must use the correct form and be sent to [email protected] where they will be taken to be filed at the time the email is received by the Commission.
Digital service of documents and reply requests
The launch of Pathway for workers compensation users will allow the Commission to introduce digital service of documents and reply requests for the majority of workers compensation Initiating application form types.
These have been used successfully in the Motor Accidents Division since the implementation of Pathway and on the former motor accidents platform.
Upon registration of an application:
- the Commission Registry will e-serve the application and supporting documents to the respondent to view via the Pathway Portal along with a reply request that can be actioned by the respondent within the Portal
- the filing party will no longer need to serve those documents on the respondent or provide a certificate of service, reducing administrative burden
- when confirming the application registration via email, the Commission will no longer attach sealed applications, supporting documents or a proceedings timetable, as this information will be available in the Pathway Portal for both parties and in listings notification emails that will follow soon after (where listings are required).
This new process will apply to the following application types:
- Form 2 - Application to Resolve a Dispute
- Form 7 - Application for Assessment by a Medical Assessor
- Form 10 - Appeal Against a Decision of Medical Assessor
- Form 11B - Application to Cure a Defective Pre- filing Statement
- Form 11C - Application for Mediation to Resolve Work Injury Damages Claim
- Form 20 - Miscellaneous
- Form 15 - Application for Assessment of costs
- Form 15A - Application for Assessment of costs
- Form 15B - Application for Assessment of costs
For the following applications, the filing party will still need to pre-serve the respondent before lodging an application. The Commission Registry will request the reply upon registration.
- Form 1- Application for Expedited Assessment
- Form 1A - Application to Revoke an Interim Payment Direction
- Form 6 - Application to Resolve a Workplace Injury Management Dispute
The following application types will still require the filing party to serve the application and supporting documents and proceedings timetable after the application is registered.
These documents will be available in the Pathway Portal for the filing party to download and serve. They will no longer be emailed these as attachments to protect data security.
