Pathway
Pathway Ready to Launch for Workers Compensation Next Week
The Commission is on track to transition all workers compensation users to its single digital platform called ‘Pathway’ next week. This follows the successful implementation of the platform for motor accidents users in June last year. The transition will complete the Commission’s mission to have all tribunal users engaging with us in the same platform in a similar way.
A comprehensive education and training program is underway to support those who will be moving to the platform. Thank you to everyone who has attended a session so far and for your feedback that you found them helpful.
Reminder: Platform outages for all workers compensation and motor accidents users
To enable migration of workers compensation data into Pathway ahead of the launch, the Commission’s platforms for both motor accidents and workers compensation users will be unavailable from 5pm today, Friday 7 June.
- MyFiles and the Online Portal for workers compensation users will cease operation from 5pm on Friday 7 June.
- myPathway and the Pathway Portal will be unavailable for motor accidents users from 5pm on Friday 7 June.
All workers compensation and motor accidents users can commence using myPathway and the Pathway Portal as follows:
- My Pathway (for decision makers): 10am, Tuesday 11 June
- Pathway Portal (for tribunal users): 9am, Wednesday 12 June
The Commission strongly encourages parties to file anything time sensitive by 5pm, Friday 7 June and to withhold filing until 9am Wednesday 12 June.
For urgent applications or documents that need to be filed during the outage, Rule 23(3)(a)will be used as the mechanism to allow filing via email. These should be submitted to [email protected] where they will be taken to be filed at the time the email is received by the Commission.
For next week only, during the transition, we will also accept hard copy forms and documents at our Registry desk on level 21 at 1 Oxford Street Darlinghurst.
Motor accidents forms are already available on the Applying online page of the Commission website and key workers compensation forms will be available there from the commencement of the outage.
Reminder: Digital service of documents and reply requests
The launch of Pathway for workers compensation users will allow the Commission to introduce digital service of documents and reply requests for the majority of workers compensation initiating application form types.
This approach has been used successfully in the Motor Accidents Division since the implementation of Pathway and on the former motor accidents platform. After an application is registered, the Commission will serve the documents on the respondent or their legal representative via the Pathway platform, if their details are included on the application. This will allow for more secure sharing of documents within the platform.
For applications where digital service of documents and reply requests are used:
- Upon registration of an application the Commission Registry will confirm the application registration via email to the filing party, however will not attach sealed applications, supporting documents or a proceedings timetable, as this information will be available in the Pathway Portal for both parties and in listings notification emails that will follow soon after (where listings are required)
- The filing party will no longer need to serve those documents on the respondent or provide a certificate of service, reducing administrative burden
- The Commission Registry will digitally serve the application, supporting documents and a request for reply to the respondent or their legal representative to view via the Pathway Portal.
- The respondent or their legal representative will be notified via an email notification that includes the reply due date and instructions to view the matter and submit their reply via the Pathway Portal
For more detail on the application form types this will apply to and the exceptions to this process, click here.
We are communicating directly with workers compensation users about what they need to know and do to prepare to use the new platform next week. Comprehensive training and reference materials will be available on the Commission website at launch and our Digital Support Team will be available to provide technical or ‘how to’ support.
Attorney General's visit
The Commission was honoured to host the Attorney General, the Hon. Michael Daley, last week on an official visit to our premises at 1 Oxford Street.
The Attorney General is responsible for appointing the Commission’s statutory members and has joint responsibility for the Personal Injury Commission Act 2020, so his visit was a special occasion for many of our people.
As well as touring the Commission’s hearing rooms and medical suites, the Attorney General addressed our decision makers and staff, affirming the important role the Commission plays in making justice accessible for injured people.
L:R Deputy President Elizabeth Wood, Division Head Marie Johns, President Judge Gerard Phillips, Attorney General, the Hon. Michael Daley, Division Head Glenn Capel, Principal Registrar Marianne Christmann
